Clifford Chance
Kristian Maley's practice focuses on resolving construction disputes on major projects across the energy transition, resources, building, and infrastructure sectors.
His experience extends to all major forms of dispute resolution, with recent experience in arbitration (including as advocate) under the ICC, SIAC, UNCITRAL, and ACICA rules; domestic arbitration; litigation; adjudication; and mediation. Kristian also assists owners, contractors, and consultants with contract and claims management and dispute avoidance.
- Representing a European multinational contractor (including appearing as counsel) in a large-scale (USD 1.5 billion) ICC arbitration concerning claims under a contract for the construction of a jetty for a major offshore LNG project in Australia.
- Representing Duro Felguera in a SIAC arbitration against Samsung C&T Corporation for claims of circa USD 1 billion relating to the construction of the Roy Hill Iron Ore mine in Western Australia.
- Representing an Australian subcontractor against an EPC contractor in a dispute relating to an iron ore expansion project in Western Australia.
- Advising a South African contractor advising on contract and claims management and dispute adjudication in relation to an Australian wind project.
- Acting for John Holland (as in house counsel) in a AU$300 million dispute with the State of Western Australia, and related subcontractor disputes, arising from the Perth Children's Hospital project.
- Representing a European subsea contractor in an UNCITRAL arbitration concerning installation of an FPSO for an Indian state-owned energy corporation.
- Acting for JGC Corporation in a statutory adjudication and associated enforcement proceedings in the Northern Territory Supreme Court concerning the Ichthys LNG project in Darwin, Australia.
- Representing a European multinational contractor in a Singapore-seated UNCITRAL arbitration against a Chinese manufacturer of bulk handling equipment for an Australian mining project, and acting in related court proceedings in Australia and China.
- Acting for John Holland (as in house counsel) in a dispute with a subcontractor on the Northlink WA Stage 1 urban highway expansion project.
