Dieter Paemen's practice focuses on European and Belgian antitrust law. He has over twenty five years of experience advising clients in European and Belgian merger clearance procedures, cartel investigations, abuse of dominance investigations, licensing and distribution agreements, and copyright and unfair competition issues. He acts for complainants and defendants as well as interested third parties.
Dieter has particular expertise in the information technology, retail, and manufacturing industries. He appears in proceedings before the European Commission, the EU Courts and the national competition authorities of several Member States, including the Belgian Competition Council. He also represents clients in legislative advocacy before the EU institutions in relation to antitrust and IP matters.
- Advised various parties in the EU abuse of dominance investigation of Google's practices in Search and Android
- Advised a party in respect of the first European Commission investigation regarding the use of injunctions based on standard-essential patents (SEPs)
- Advised Oracle on several EU merger clearances, including the acquisitions of PeopleSoft and Sun Microsystems, and the appeal of the Oracle/Sun clearance decision before the General Court in Luxembourg
- Advised various parties in the EU abuse of dominance investigation of Microsoft and the follow-on appeals before the General Court in Luxembourg
- Advised KONE in connection with the European Commission's 'Elevators & Escalators' cartel investigation, the subsequent appeals, a preliminary reference to the Court of Justice of the European Union, and civil damages claims before certain national courts
- Advised on Belgian merger clearances in connection with the acquisition of an airport, the joint acquisition of a television station, and the acquisition of a power company, as well as on various other Belgian antitrust matters
- Undertaking legislative advocacy in connection with various EU legislative initiatives before the European Commission, the European Parliament and various Member States
